You are granted a non-exclusive, non-transferable, revocable license to access and use dexterdrone.com strictly in accordance with these terms. As a condition of your use of the Site, you warrant to Dexter Drone that you will not use the Site for any purpose that is unlawful or prohibited by these Terms. You may not use the Site in any manner which could damage, disable, overburden, or impair the Site or interfere with any other party's use and enjoyment of the Site. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Site.
All content included on dexterdrone.com, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Site, is the property of Dexter Drone or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights. You agree to observe and abide by all copyright and other proprietary notices, legends or other restrictions contained in any such content and will not make any changes thereto.
You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Site. Your use of the Site does not entitle you to make any unauthorized use of any protected content, and in particular you will not delete or alter any proprietary rights or attribution notices in any content. You will use protected content solely for your personal use, and will make no other use of the content without the express written permission of Dexter Drone and the copyright owner. You agree that you do not acquire any ownership rights in any protected content. We do not grant you any licenses, express or implied, to the intellectual property of Dexter Drone or our licensors except as expressly authorized by these Terms.
Requesting Flights
Requesting a flight is not a guarantee that a service will be offered. Requesting a flight is asking Dexter Drone if they are able to perform such service. After Dexter Drone creates a flight plan and the customer has agreed to such plan by making payment for each service requested, a contract has been made between Dexter Drone and the customer. This contract does not guarantee that each requested service will be able to be performed. This contract means Dexter Drone will attempt to perform each requested service as described in the flight plan. In the event Dexter Drone is unable to be perform a requested service, the service will either be cancelled or rescheduled for a later timeframe as described in the Terms of Service under Cancellation of Services.
Max Time with Pilot
When the pilot is on-site and takes-off for the first time, the max time with pilot clock starts. When the max time with pilot is reached, the pilot will cease operations. If the customer requests a longer max time with pilot, the customer will be billed at a rate of $50 per hour.
Cancellation of Services
If the customer decides to cancel any service offered by Dexter Drone after a payment is made for such service, Dexter Drone will issue a full refund minus a $20 cancellation fee.
If Dexter Drone decides to cancel any service it offers after the customer has made a payment for such service, Dexter Drone will:
Offer a full refund for each service Dexter Drone cancels; OR
If agreed upon by both Dexter Drone and the Customer, Dexter Drone will instead offer a new timeframe to perform each canceled service.
Quality of Content Provided
If the customer has payed for a service and such service has been fulfilled and delivered by Dexter Drone, the customer must notify Dexter Drone of any quality concerns with each service that has been provided within 24 hours of delivery. When Dexter Drone digitially sends or physically delivers the final content (photos/videos), delivery has been made.
Dexter Drone does not guarantee the quality of the content (photos/videos) it provides to be 100% imperfection free. The customer should expect, as with any photography/videography, minor imperfections could exist that are out of the control of the photographyer/videographer.
If Dexter Drone is notifed of a quality concern within 24 hours of delivery, Dexter Drone will determine the impact that each quality concern has caused for each service provided. If the impact is minor and does not damage the overall content (photo/video), Dexter Drone will not provide any refunds. If the impact is major and does damage the overall content (photo/video), Dexter Drone may offer a partial refund or attempt to perform such service again, free of charge.
Ownership of Content Provided
Dexter Drone has sole ownership of all content it creates during any service it provides. Ownership of the final content provided to the customer will be transferred to the customer when:
The customer has fully paid for all requested services, AND
Dexter Drone has delivered the final content.
If the customer has paid for a service, and after the payment is made, the customer cancels, voids, disputes, stops the payment, or the payment bounces, the customer will immediately forfeit ownership of the content it has been provided by Dexter Drone from such service and ownership of that content will be transferred back to Dexter Drone. The customer will be responsible for paying any fees Dexter Drone incurs resulting from a payment issue. The ownership of such content will only be returned to the customer when Dexter Drone has received full payment for the service, including any additional fees incurred.
If Dexter Drone has additional unused content, such as leftover unused photos and/or videos, Dexter Drone will retain sole ownership of such content. If the customer purchases the additional unused content from Dexter Drone, ownership of such content will be transferred to the customer.
After ownership of content provided by Dexter Drone has been transferred to the customer, Dexter Drone may ask the customer for permission to display the content on the dexterdrone.com website for the purpose of showing samples to other potential customers. This request is optional and the customer is not obligated to accept the request. If the customer has approved the request but later wishes to have the content removed from the dexterdrone.com website, the customer must notify Dexter Drone and allow at least 24 hours for the content to be removed from the dexterdrone.com website.
Changes to Terms of Service
Dexter Drone reserves the right, in its sole discretion, to change the Terms of Service at any time, with or without notice. The customer is responsible for reviewing the terms of service before requesting any Dexter Drone service.
